NBA News Update: NBA set to stabilize and commence Access to Finance Scheme for Lawyers report goes thus
As I mentioned to you during the NBA electioneering campaigns in 2020, the need for a stabilisation or “rainy-day” fund for an association like ours cannot be overemphasized. Leading Bar Associations around the world have, over the years, set aside significant amounts that they can resort to for their major expenses, especially when there is a considerable fluctuation in their revenues.  I therefore campaigned on the importance of a savings culture and proper investment of our funds at the NBA as a way to not only growing our assets base, but also minimizing interference from external bodies that may have a stronghold on the Association on account of funding, donations, and grants.

I also mentioned that access to, and availability of, finance for lawyers is a major issue that requires institutional attention from the NBA.  I believe that unlocking access to capital for our deserving members is key to improving our law practices, increasing revenue generation for lawyers, and overall bettering our professional lives.
On that basis, in a recent correspondence to you, I informed you that we, together with the members of the NBA Finance Committee (under the joint leadership of Seni Adio, SAN and Mazi Okechukwu Unegbu), were working on a framework to deal with each of these issues.  I am pleased to report that the targets that we set for ourselves on those points are now being realized as follows:
NBA Stabilisation Fund 
We have set up the NBA Stabilisation Fund which we have already saved up and set aside the sum of N1billion for, and now commit to having up to N1.5billon (in the aggregate), at the minimum, deposited in the fund, over the next few months.  The fund will invest in a portfolio of assets that will generate steady returns for the Association over time.  A team of subject matter experts have developed investment guidelines on how the Fund will be managed, invested, and utilised.  The National Executive Council of the NBA approved the establishment of the Fund at its meeting held on 16th December 2021.
Access to Finance for Lawyers 
We have set up an access to finance scheme for lawyers who may require loans, at single digit, or less than market, interest rates, for their working capital and operational needs.  The scheme involves enabling borrowing by eligible lawyers from two designated commercial banks (First Bank of Nigeria and Access Bank PLC) under an arrangement that is backstopped or cash-backed by the NBA.  Among other terms that will be detailed in the documents that a lawyer is expected to sign with a participating bank, it is important to highlight the following:
 

Maximum amount available to each lawyer
 
This depends on a needs assessment and creditworthiness of the lawyer and will be agreed between the lawyer and the participating bank, but for proper risk management, will not exceed the sum of N2million per borrower.
Cash collateral provided by NBA
 
Up to N1.5billion linked to the NBA Stabilisation Fund
Tenor Up to 3 years
 
Interest rate 9.5% per annum
 
Some loan conditions Among other things, to be eligible, the lawyer will need to provide the following to the participating banks:

  • Evidence of payment of practising fees and NBA branch dues for three years (the year of application and the two years preceding that)

 

  • Signed but undated cheques from the lawyer’s bankers for the value of the amount borrowed

 

  • A letter from the lawyer irrevocably domiciling his/her salaries, or law firm receivables with the participating bank

 

  • A letter of good standing from the NBA

 

  • A copy of call to Bar certificate of the borrower (in the case of an individual), or of the partners (in the case of a partnership)

 

  • A Global Standing Instruction to the participating banks to set off any amount owed on the balance of the lawyer both within the bank and in any other bank

 

  • A credit insurance cover
How to access the loan Disbursements under the scheme will commence in January 2022.  Relevant contact details of the Access Bank and First Bank team members will be circulated in January 2022.
 
Before approaching either participating bank, be sure of the amount that you wish to borrow under the arrangement and of your ability to repay as and when due.
 
Read the offer letter and loan documents carefully.  Members of the NBA Finance Committee have agreed the general terms of the template offer letter with each participating bank, but lawyers should read through the terms themselves before making any commitments.

 
The NBA and the participating banks have agreed a tiered mechanism for enforcement in the event of default on the loan, which includes the possibility of deeming a default as professional misconduct.  As such, we encourage our members to borrow prudently and only for purposes that will help expand their operations, improve their practices, grow their revenues, and ultimately better their professional lives.
 
The NBA Finance Committee will circulate further correspondence regarding the Access to Finance Scheme in due course.

HON. JUSTICE M. MUKHTARAn accomplished Jurist, Administrator, trail blazer & Mentor, Honourable Justice Aloma Mariam Mukhtar was born in Lagos on November 20, 1944.
She acquired her primary school education in Zaria, and obtained her [GCE] ‘O’ Levels at Rossholme School for Girls in East Brent, Somerset England in 1962. She went on to Gibson & Welder Law School where she graduated in 1966 and was called to the English Bar, Middle Temple the same year, and to the Nigeria Bar in 1967.
 
Honourable Justice Aloma Mukhtar’s career advancement is a product of hard work, dedication and perseverance. She joined the Northern Nigeria Ministry of Justice as a Pupil State Counsel and Magistrate Grade 1, between [1969-1973]. She returned to her native Kano State in 1973 to assume duties as Chief Registrar of the State Judiciary and in 1977, was appointed a Judge of the High Court of Kano State.
Honourable Justice Aloma Mukhtar was nominated as Justice of the Court of Appeal of Nigeria in 1987, where she spent 17 years, twelve of which she served as President.
Elevated to the Supreme Court of Nigeria in June 2005, she reached the apogee of the legal profession when she was appointed to the exalted position of Chief Justice of Nigeria [CJN] in July 2012, which position she held for about two years.
Her speech when she appeared before the Senate screening, gave a clear direction of her tenure as CJN, she said “Corruption is in every system of our society and I cannot pretend that it is not in the Judiciary. I intend to lead by example and to hope and pray that others will follow. I will encourage internal cleansing based on petition and as much as possible ensure that bad eggs are removed, so that the confidence reposed in the judiciary will be restored once again” . Indeed, this she pursued vigorously until her retirement in 2014 after a meritorious career spanning nearly five decades.
In the interim also, [May 2011 – July 2012], she had served as a Justice of the Supreme Court of The Gambia.
Described as an “independent, transparent, courageous, fearless yet humble and a fair-minded Jurist” by her colleagues and legal practitioners alike, Honourable Justice Aloma Mukhtar was one of the three Justices of the Supreme Court who took a dissenting stance in the 2007 Presidential election dispute on the grounds of substantial non-compliance with the Electoral Act 2006, which should have nullified the election of Alhaji Umaru Musa Yar’Adua.
During her distinguished career, Honourable Justice Aloma Mukhtar scored quite a number of significant ‘Firsts’. In June 1967, she became the first female lawyer in Northern Nigeria [covering 19 States], and subsequently its pioneer female Magistrate in the Northern region. She was the first female Chief Registrar of the Kano State Judiciary, the first female Judge of the High Court in Kano State, and the first woman jurist to be appointed to the Court of Appeal and the Supreme Court of Nigeria. In July 2012, she became the first female Chief Justice of Nigeria [CJN].
Since leaving office as CJN, she has joined Nigeria’s highest advisory body, the National Council of State as its first female permanent member.
A Life Bencher; Fellow, The Nigerian Institute of Advanced Legal Studies; Fellow, Chartered Institute of Arbitrators and Fellow of the Nigerian Law School, Honourable Justice Aloma Mukhtar has been recognized nationally and internationally for her value-added contributions to the growth and development of the judiciary. She has the rare distinction of being the recipient of three of the highest Nigerian National Honours, namely: Commander of the Order of the Niger [CON], Commander of the Federal Republic [CFR] and Grand Commander of the Order of the Niger [GCON].
Among others, she has also been honoured by the International Federation of Women Lawyers [FIDA], and with the Life-Membership of the International Association of Women Judges; Gold Merit award of the Kano State Government, Vice President, International Association Of Women Judges, Foundation President, Nigerian Association of Women Judges; Induction into The Nigerian Women Hall of Fame; and Honorary Doctor of Letters from University of Abuja.

From its humble beginning in 1963 with 8 students at its one block Campus at 213A, Igbosere Road, Lagos, the Nigerian Law School has grown to a six-Campus Institution spread across the country with a yearly intake of well over 6,000 (six thousand) students as stated above.

It is a tribute to the School that all Judges of the various Courts in Nigeria (including the Chief Justice of Nigeria) are products of the Nigerian Law School. Likewise, the Attorney-General of the Federation and Minister of Justice, all States’ Attorneys-General and Commissioner for Justice and Law Officers serving in their Chambers are all products of the School. It is also significant that a large number of members of various tiers of the legislative arm of government in the country are products of the School. 5
The School has also contributed to the training of the legal manpower for our sister African countries like the Republic of the Gambia, the Republic of Sierra Leone, and the Republic of Cameroun. A number of countries from East and West Africa have visited the Law schools to solicit information and assistance on the establishment and development of the Law schools in their various countries. Just recently the Nigerian Law School received a high-powered delegation from the Law Development Centre, Uganda, who was in Nigeria on benchmarking and working visit to the Nigerian Law School. The products of the School have a commanding presence in another sphere of the public and private sectors such as the Military, Police, Customs, Immigration, the Oil and Gas sector, Banking and Finance, Insurance and the Corporate world in general, Professors/Lecturers in the Universities and other tertiary institutions.

Having attorneys retained by families as ‘family lawyers’ may be viewed as a means of attaining the divinely ordained equal justice for all. But delays in the justice system, poverty, and low awareness are among the factors that could hamper the use of family lawyers in Nigeria.
Professor C.J. Amasike, chairman of the International Dispute Resolution Institute (IDRI) said disputes are inevitable in human relations, explaining that this raises the need for adjudication, which he said are better handled by persons with skills of Alternative Dispute Resolution (ADR) mechanisms.
“Disputes and conflicts are part of human nature. Even in heaven there was a fight between Lucifer and his supporters and Angels,” he said.
Kehinde Ogunwumiju (SAN) said lawyers are not just meant for families’ cases but also those in big businesses.
“For instance, if it is a family that have a lot of lands, property, business, like those big families in Lagos and Ondo states, you have lawyers that help them deal with them,” he said.
“Having family lawyers is very important,” according to Barr Ezenwa Anumnu, a factional chairman of the Nigerian Bar Association (NBA), Abuja Branch. “You find out that you might always have issues that need a lawyer. In Abuja the law practice is still like trading, but in Lagos you have family lawyers for writing of wills, agreements, estates, conveyancing etc.”
On the form of fees for such lawyers retained by families, Anumnu said there are no hard and fast rules around the payment of legal fees for such lawyers.
“It depends on what you agree with the person. The lawyer may discount some fees and may not charge on commercial rate depending on some other services or provisions provided for them.
“Everybody must have a doctor and a lawyer. You might always have issues to deal with lawyer and doctor. For instance, everybody should make a will, it’s not as if they are going to die,” he added.
For his part, Barr Francis Mgboh said it is ‘very essential’ for every family to retain a lawyer, some of which could be family members or friends, who could always render legal advice to avoid mistakes.
“It is more essential than having a doctor. Ignorance of the law is not an excuse to commit an offense. Your lawyer is a guide to live in a better society,” he said.
However, many believe as necessary as the need could be, the financial implication could prove too much for many families.
Human Rights lawyer Perspective
A human rights lawyer, Hamid Ajibola Jimoh said just as corporate bodies engage law firms as counsel, it is necessary to have family lawyers in order to avoid troubles, citing medical practice where doctors are engaged.
He however identified financial incapacity as major hinderance to the idea of retention of lawyers by families unlike the case in medical practice, where he said “health is regarded as wealth, which is unavoidable.”
The General Secretary of the Nigerian Bar Association (NBA)’s View
In the same vein, the General Secretary of the Nigerian Bar Association (NBA), Isiaka Olagunju said though there is need for every family to have a lawyer in Nigeria, it is not realistic because of the level of poverty in the country.
He agreed that services of lawyers may not be paid for where the professional rules for pro bono services by lawyers are put into consideration.
Olagunju pointed out that there are about 106,000 lawyer on the roll call of practicing lawyers in Nigeria and the Bar is looking at reducing the numbers for better quality service. But for a country with 198 million people, many would view this figure as insufficient to go round.
Jimoh said the tendency is for everybody to avoid legal issues and troubles. The delay in the disposal of cases in Nigeria affects the confidence of the people in the judicial system.
The Supreme Court still presides over cases, which are inherited by different generations in a family.
Despite all its challenges, the justice system is preferable rather than to self-help. The authorities must therefore do all they can to enhance access to justice and speedy adjudication in the society.

Family lawyers in Nigeria : Myth or reality
 
Having attorneys retained by families as ‘family lawyers’ may be viewed as a means of attaining the divinely ordained equal justice for all. But delays in the justice system, poverty, and low awareness are among the factors that could hamper the use of family lawyers in Nigeria.
 
Professor C.J. Amasike, chairman of the International Dispute Resolution Institute (IDRI) said disputes are inevitable in human relations, explaining that this raises the need for adjudication, which he said are better handled by persons with skills of Alternative Dispute Resolution (ADR) mechanisms.
 
“Disputes and conflicts are part of human nature. Even in heaven there was a fight between Lucifer and his supporters and Angels,” he said.
 
Kehinde Ogunwumiju (SAN) said lawyers are not just meant for families’ cases but also those in big businesses.
 
“For instance, if it is a family that have a lot of lands, property, business, like those big families in Lagos and Ondo states, you have lawyers that help them deal with them,” he said.
 
“Having family lawyers is very important,” according to Barr Ezenwa Anumnu, a factional chairman of the Nigerian Bar Association (NBA), Abuja Branch. “You find out that you might always have issues that need a lawyer. In Abuja the law practice is still like trading, but in Lagos you have family lawyers for writing of wills, agreements, estates, conveyancing etc.”
 
On the form of fees for such lawyers retained by families, Anumnu said there are no hard and fast rules around the payment of legal fees for such lawyers.
 
“It depends on what you agree with the person. The lawyer may discount some fees and may not charge on commercial rate depending on some other services or provisions provided for them.
 
“Everybody must have a doctor and a lawyer. You might always have issues to deal with lawyer and doctor. For instance, everybody should make a will, it’s not as if they are going to die,” he added.
 
For his part, Barr Francis Mgboh said it is ‘very essential’ for every family to retain a lawyer, some of which could be family members or friends, who could always render legal advice to avoid mistakes.
 
“It is more essential than having a doctor. Ignorance of the law is not an excuse to commit an offense. Your lawyer is a guide to live in a better society,” he said.
 
However, many believe as necessary as the need could be, the financial implication could prove too much for many families.
 
Human Rights lawyer Perspective
 
A human rights lawyer, Hamid Ajibola Jimoh said just as corporate bodies engage law firms as counsel, it is necessary to have family lawyers in order to avoid troubles, citing medical practice where doctors are engaged.
 
He however identified financial incapacity as major hinderance to the idea of retention of lawyers by families unlike the case in medical practice, where he said “health is regarded as wealth, which is unavoidable.”
 
The General Secretary of the Nigerian Bar Association (NBA)’s View
 
In the same vein, the General Secretary of the Nigerian Bar Association (NBA), Isiaka Olagunju said though there is need for every family to have a lawyer in Nigeria, it is not realistic because of the level of poverty in the country.
 
He agreed that services of lawyers may not be paid for where the professional rules for pro bono services by lawyers are put into consideration.
 
Olagunju pointed out that there are about 106,000 lawyer on the roll call of practicing lawyers in Nigeria and the Bar is looking at reducing the numbers for better quality service. But for a country with 198 million people, many would view this figure as insufficient to go round.
 
Jimoh said the tendency is for everybody to avoid legal issues and troubles. The delay in the disposal of cases in Nigeria affects the confidence of the people in the judicial system.
 
The Supreme Court still presides over cases, which are inherited by different generations in a family.
 
Despite all its challenges, the justice system is preferable rather than to self-help. The authorities must therefore do all they can to enhance access to justice and speedy adjudication in the society.
