Court News: 70 years old man sentenced to death for rape.
The Shariah court in Kano recently sentenced a 70 years old man identified as Mati Abdu to death by stoning for defiling a minor.
Abdu, who hails from Farsa village in Tsanyawa Local Government area of Kano State was said to have allegedly raped a 12-year-old girl in a broad daylight and under a tree at Farsa Village sometimes in 2019.
The Presiding Judge of the Shariah court sitting in Kofar Kudu, Khadi Ibrahim Sarki Yola gave the judgment after finding Abdu guilty of the offense.
Yola however sentenced Abdu based on Section 127 subsection (b) of the Kano State Shariah Penal Code Law 2000.
Earlier, the prosecution counsel, Barrister Badariya Bala Shehu said the convict committed the offense about 1:00 p.m where he had unlawful sexual intercourse with the 12-year-old girl under a tree situated at Farsa village, Tsanyawa local government area in Kano.
He (Abdu) pleaded guilty of the offence.
The offense contravenes Section 126 of Kano State Shariah Penal Code Law 2000.

Having attorneys retained by families as ‘family lawyers’ may be viewed as a means of attaining the divinely ordained equal justice for all. But delays in the justice system, poverty, and low awareness are among the factors that could hamper the use of family lawyers in Nigeria.
Professor C.J. Amasike, chairman of the International Dispute Resolution Institute (IDRI) said disputes are inevitable in human relations, explaining that this raises the need for adjudication, which he said are better handled by persons with skills of Alternative Dispute Resolution (ADR) mechanisms.
“Disputes and conflicts are part of human nature. Even in heaven there was a fight between Lucifer and his supporters and Angels,” he said.
Kehinde Ogunwumiju (SAN) said lawyers are not just meant for families’ cases but also those in big businesses.
“For instance, if it is a family that have a lot of lands, property, business, like those big families in Lagos and Ondo states, you have lawyers that help them deal with them,” he said.
“Having family lawyers is very important,” according to Barr Ezenwa Anumnu, a factional chairman of the Nigerian Bar Association (NBA), Abuja Branch. “You find out that you might always have issues that need a lawyer. In Abuja the law practice is still like trading, but in Lagos you have family lawyers for writing of wills, agreements, estates, conveyancing etc.”
On the form of fees for such lawyers retained by families, Anumnu said there are no hard and fast rules around the payment of legal fees for such lawyers.
“It depends on what you agree with the person. The lawyer may discount some fees and may not charge on commercial rate depending on some other services or provisions provided for them.
“Everybody must have a doctor and a lawyer. You might always have issues to deal with lawyer and doctor. For instance, everybody should make a will, it’s not as if they are going to die,” he added.
For his part, Barr Francis Mgboh said it is ‘very essential’ for every family to retain a lawyer, some of which could be family members or friends, who could always render legal advice to avoid mistakes.
“It is more essential than having a doctor. Ignorance of the law is not an excuse to commit an offense. Your lawyer is a guide to live in a better society,” he said.
However, many believe as necessary as the need could be, the financial implication could prove too much for many families.
Human Rights lawyer Perspective
A human rights lawyer, Hamid Ajibola Jimoh said just as corporate bodies engage law firms as counsel, it is necessary to have family lawyers in order to avoid troubles, citing medical practice where doctors are engaged.
He however identified financial incapacity as major hinderance to the idea of retention of lawyers by families unlike the case in medical practice, where he said “health is regarded as wealth, which is unavoidable.”
The General Secretary of the Nigerian Bar Association (NBA)’s View
In the same vein, the General Secretary of the Nigerian Bar Association (NBA), Isiaka Olagunju said though there is need for every family to have a lawyer in Nigeria, it is not realistic because of the level of poverty in the country.
He agreed that services of lawyers may not be paid for where the professional rules for pro bono services by lawyers are put into consideration.
Olagunju pointed out that there are about 106,000 lawyer on the roll call of practicing lawyers in Nigeria and the Bar is looking at reducing the numbers for better quality service. But for a country with 198 million people, many would view this figure as insufficient to go round.
Jimoh said the tendency is for everybody to avoid legal issues and troubles. The delay in the disposal of cases in Nigeria affects the confidence of the people in the judicial system.
The Supreme Court still presides over cases, which are inherited by different generations in a family.
Despite all its challenges, the justice system is preferable rather than to self-help. The authorities must therefore do all they can to enhance access to justice and speedy adjudication in the society.

Rape case: D’Banj sues Seyitan for 1.5 billion naira


In an alleged rape case, Nigerian entertainer, Oladapo Daniel Oyebanjo popularly know as D’banj, on Friday sued one Miss Seyitan Babatayo for N1.5 billion for alleging that she was raped by Dapo Oyebanjo in a Lagos hotel in 2018.
The lawsuit was signed by D’banj and presented to the high court of the FCT by his lawyer, Mike Ozekhome, on Friday.
In the filing it was said that, D’banj requested the court to order Ms Babatayo to tender a letter of apology for the accusations directed at him, which he claimed has caused him “embarrassment, ridicule, derision, marital disharmony, mental agony, and psychological trauma.” (PREMIUM TIMES).
It was also reported that D’banj requested in the document that his accuser pays him N1 billion to cover for the general damages that her actions have caused him.
“An order directing the defendant to pay the claimant, the sum of #1, 000,000,000.00 (One Billion Naira) only, representing general damages over the untold embarrassment, derision, public ridicule, odium, obloquy, marital disharmony, mental agony and psychological trauma which the defendant’s tweets and publication have caused the claimant,” the document read in part.
The award-winning musician D’Banj also requested an additional N500 million, which he said represents the “aggravated, punitive, and exemplary damages” that he incurred.
All efforts to reach Ms Babatayo’s lawyers, Ojoge, Omileye, and Partners, were unsuccessful as telephone calls and text messages sent to them were unanswered.
Ayodeji Osowobi, the director of Stand To End Rape, a non-profit that has taken up Ms Babatayo’s case, has also declined to make any official statement about the suit.
She, however, explained that Ms Babatayo will soon be releasing a statement detailing her experience in the past week.
The Hullabaloo started early June 2020 when one Nigerian model scout, Benjamin Ese when on social media claiming that Dbanj raped his friend inside a hotel in Lagos in 2018.
Ms Sheyitan’s accusation began shortly after D’banj joined other celebrities to preach against rape when he said ‘No means No’.

About the Author
Nigel Blackaby is a partner in the international arbitration group and head of Freshfields Bruckhaus Deringer’s US and Latin America international arbitration groups. Nigel acts as counsel and arbitrator with a particular focus on Latin America. He has represented foreign investors and states in arbitration proceedings under the auspices of the ICSID, UNCITRAL, ICC, LCIA and AAA in English, Spanish and Portuguese. Nigel is an editor of Arbitration International, a council member of the LCIA Latin America Users’ Committee and of the Advisory Board of the Investment Treaty Forum of the British Institute of International and Comparative Law. He is editor and co-author of International Arbitration in Latin America (2003), a co-author of A Guide to ICSID Arbitration (2004) and a co-author of the fourth edition of Redfern & Hunter on International Commercial Arbitration (2004). He is an occasional postgraduate lecturer in arbitration at the University of Paris I – Sorbonne.
Constantine Partasides is a partner and head of Freshfields Bruckhaus Deringer’s international arbitration group in London. He has acted as counsel and arbitrator in approximately fifty ad hoc and institutional arbitrations, including under the rules of the ICC, LCIA, AAA and ICSID. In recent years, Constantine has specialized in arbitrations in the energy sector arising under contracts and investment treaties. Alan Redfern is a member of One Essex Court. He has acted as chairman, sole arbitrator or party-nominated arbitrator in numerous disputes, including ad hoc arbitrations, as well as those conducted under the UNCITRAL Arbitration Rules and under the leading arbitral regimes, including ICC, LCIA, UNCITRAL, AAA and ICDR. Alan is a vice-president of the International Court of Arbitration of the International Chamber of Commerce in Paris. He is also a non-executive director of the London Court of International Arbitration. He is on the international panel of the American Arbitration Association and of arbitral institutions in Europe, the Middle East and elsewhere.
Martin Hunter was a partner of the firm known as Freshfields from 1967 to 1994, latterly leading the firm’s International Arbitration Group. After retiring from the firm he requalified as a barrister and joined Essex Court Chambers, where he continues to practice in the field of international arbitration, both as counsel and as an international arbitrator.
In 1995 he was appointed to the newly-established Sweet & Maxwell chair of international dispute resolution at Nottingham Trent University , and has undertaken teaching assignments at King’s College London and at universities around the world.
He is chairman of the Board of Trustees of DIAC; was Deputy Chairman of the committee that advised the UK Government on the 1996 Arbitration Act; is a member of ICCA; and has served on the Arbitration Courts of the ICC and LCIA .
He has also been published extensively extensively in specialist arbitration journals and elsewhere over the last twenty-five years.

Consumer Rights: Real or Illusion?


Opinion: Consumer protection Real or Illusion
In this survey our reporter asked Nigerians about views concerning the rights of consumers and obligations of service providers according to the consumer protection law if it truly is functional or not. Their response about this law is intriguing.
Mrs. Najite Okugbere a financial analyst is of the opinion that consumer rights awareness low in Nigeria so people do not know if the law exists or not. As such they proposed that unawareness may have affected utilization of consumer protection law she  recommends that  the enactment of consumer  rights, the law enforcement agencies of consumer protection should see to it that consumers know their right. In her words “the enforcement agency should educate people to know that it is their right to ask questions about products they are not sure of and it is their rights to demand for quality products and services and get value for their money.”
 
In support of Mrs Okugbere, Mrs Margret Akpan utilization of consumer rights by
the Nigerian consumers remains an issue of concern because consumers are ignorant on where
to turn to in case they encounter an irresponsible producer or service provider. In her words “ When we are maltreated by companies we don’t know where to go to, we don’t know who to turn to especially with most of this foreign companies and they are using it against us because we don’t know the law, we don’t even know our rights.”
 
Ms. Bidemi Adesanya  a hair stylist says she does not know if there is anything as consumer right law because she has never heard of  it, hence she is not aware of the act
 
Mr. Ladipo Akinola says that the consumer protection law is an illusion and that the government is responsible. To him “Overall responsibility for creating safe markets for consumers lies with the authorities. This is because the process involves: setting
clear rules and guidance on how to develop safe products; and providing adequate tools and resources to market surveillance and enforcement agencies to enable them to assess risks and ensure compliance so that the consumer has nothing to worry about on any products and even if they do. They know where to go and what to do when they get there.
 
Mr. George Williams a Lagos state businessman has it that “any law that is made without the citizens being informed is no law but a mere statement” he further said that  there is a serious need for the governments to step up and drive improvement within the law enforcement agencies and the media, then consumer consumers will defend their rights and ensuring that their voice is heard when substandard products and services is given to them in the development of policy, and the media  will educate the masses
 
 
From our survey, it goes to show that the consumer protection law though it exist but limited awareness of consumer rights makes it look like a mirage, thus consumer suffer exploitation in the market place.

Agency jailed staff for contract fraud

Justice A.T. Mohammed of the Federal High Court, Port Harcourt, recently sentenced one Tarila Ebizimor to seven years imprisonment for obtaining money under false pretence to the tune of N4.000.000.00 (Four Million Naira).

The convict, a supervisor in the Security Department of the Niger Delta Development Commission, NDDC, was prosecuted by the Port Harcourt Zonal Office of the Economic and Financial Crimes Commission, EFCC, on a four-count charge.
Ebizimor’s journey to prison began sometime in August, 2013 when he paraded himself as personal assistant of the managing director of the NDDC and obtained the sum of N4million from the petitioner on the pretext that he will help facilitate the award of road construction contract to him.
One of the charges against him reads: “That you Tarila Ebizimor on the 13th day of August, 2013 in Port Harcourt, Rivers State within the jurisdiction of this honorable court did fraudulently obtain the sum of N2,000,000 (Two Million Naira), which said sum was paid into your Fidelity Bank account No. 5330259983, by a means of transfer from God’s Grace Haulage Limited on the pretext that you were to facilitate the award of road construction contract from Niger Delta Development Commission (NDDC), a pretext you know to be false and thereby committed an offence, contrary to Section 1(i)(a) of Advance Fee Fraud and Other Related Offences Act, 2006 and punishable under Section 1(3) of the same Act”.
