 further pledged that the NBA will ensure that the Lawyers with Disabilities Forum (LWDF) gets more active, and promised to introduce an annual event dedicated to the LWDF where issues faced by lawyers with disabilities will be discussed.

Olumide Apata emerged new NBA boss with a landslide victory


Olumide Akpata has emerged winner of the Nigerian Bar Association’s (NBA) national elections, after defeating two other contestants who are Senior Advocates of Nigeria (SANs). This victorious win makes him the NBA’s first non-SAN President in years.
Akpata won the election with a total of 9,891 votes of the total 18,256 ballots cast, while his closest rival, Babatunde Ajibade (SAN) polled 4,328 votes and Dele Adesina (SAN) polled 3,982 votes.
The election commenced at exactly 11 am on Wednesday, July 29, and ended at 11 pm on Thursday, July 30. It was a virtual voting process where registered members of the association logged into the National Officers Election webpage with their Supreme court numbers and cast their votes.
Right from Wednesday night when the elections started, Akpata maintained the lead with more than 50% of the votes at every quarter-hourly update, and he maintained the lead up to the close of the election at 11pm on Thursday.
About 29,636 eligible voters were registered, and the election committee sent the voting link to the registered members via emails and sms.
This result represents a sudden change in the order, as Akpata is now the first non-SAN to lead the Nigerian Bar Association in years. Feedback from members of the NBA indicates that there has been a long-standing hunger for a paradigm shift. And now it appears many of the association’s members have a good reason to be excited.
Born on October 7, 1972, Akpata had his early education in Warri, Delta state. He attended Kings College, Lagos, for his secondary education and later got admitted into the University of Benin. He was called to the bar on December 15, 1993. He is a founding member of the NBA Section on Business Law (NBA-SBL), which comprises 22 committees, which focus on various areas of commercial law dating back to as far as 2006.

About the Author
Nigel Blackaby is a partner in the international arbitration group and head of Freshfields Bruckhaus Deringer’s US and Latin America international arbitration groups. Nigel acts as counsel and arbitrator with a particular focus on Latin America. He has represented foreign investors and states in arbitration proceedings under the auspices of the ICSID, UNCITRAL, ICC, LCIA and AAA in English, Spanish and Portuguese. Nigel is an editor of Arbitration International, a council member of the LCIA Latin America Users’ Committee and of the Advisory Board of the Investment Treaty Forum of the British Institute of International and Comparative Law. He is editor and co-author of International Arbitration in Latin America (2003), a co-author of A Guide to ICSID Arbitration (2004) and a co-author of the fourth edition of Redfern & Hunter on International Commercial Arbitration (2004). He is an occasional postgraduate lecturer in arbitration at the University of Paris I – Sorbonne.
Constantine Partasides is a partner and head of Freshfields Bruckhaus Deringer’s international arbitration group in London. He has acted as counsel and arbitrator in approximately fifty ad hoc and institutional arbitrations, including under the rules of the ICC, LCIA, AAA and ICSID. In recent years, Constantine has specialized in arbitrations in the energy sector arising under contracts and investment treaties. Constantine co-authored the fourth edition of ‘Law and Practice of International Commercial Arbitration’; he is the news editor of the Journal International Arbitration Law Review, and a council-member of the LCIA’s European Users Council.
Alan Redfern is a member of One Essex Court. He has acted as chairman, sole arbitrator or party-nominated arbitrator in numerous disputes, including ad hoc arbitrations, as well as those conducted under the UNCITRAL Arbitration Rules and under the leading arbitral regimes, including ICC, LCIA, UNCITRAL, AAA and ICDR. Alan is a vice-president of the International Court of Arbitration of the International Chamber of Commerce in Paris. He is also a non-executive director of the London Court of International Arbitration. He is on the international panel of the American Arbitration Association and of arbitral institutions in Europe, the Middle East and elsewhere.
Martin Hunter was a partner of the firm known as Freshfields from 1967 to 1994, latterly leading the firm’s International Arbitration Group. After retiring from the firm he requalified as a barrister and joined Essex Court Chambers, where he continues to practice in the field of international arbitration, both as counsel and as an international arbitrator.
In 1995 he was appointed to the newly-established Sweet & Maxwell chair of international dispute resolution at Nottingham Trent University , and has undertaken teaching assignments at King’s College London and at universities around the world.
He is chairman of the Board of Trustees of DIAC; was Deputy Chairman of the committee that advised the UK Government on the 1996 Arbitration Act; is a member of ICCA; and has served on the Arbitration Courts of the ICC and LCIA .

Unlike most practitioner titles published by the estimable LAG (Legal Action Group), this book is aimed at helping those who are not qualified to navigate their way through the often intricate procedures and pitfalls of an employment tribunal, including claimants acting for themselves or their unqualified, or partly qualified advisers.
However, also note the usefulness of this book for lawyers: those who find themselves involved in tribunal work only occasionally, or specialist employment lawyers who will find this book, with its practical plain-speaking approach, a valuable assistant in helping them explain tribunal matters to their often uncomprehending clients.
Logically structured, the book is divided into chapters that broadly correspond to the sequence of employment tribunal proceedings. Practical guidance on each stage of proceedings is methodically delivered chapter by chapter, while at the same time, alerting hopeful claimants to the unwritten rules inherent in the decision making process. The book demystifies the procedures as well as the jargon which emerges as an inescapable part of the tribunal process.
This new fourth edition has been updated to include, most importantly, the new employment Tribunal Rules of procedure 2013, plus useful advice on tribunal fees, as well as guidance on the Early Conciliation Process shortly due to come into force. Those fees of course, are at the centre of Cunningham and Reed’s very sound advice as to whether or not a claimant should go ahead with a claim. Think not about what you’ll get, (probably an unrealistic hope), but what it will cost you to get it – is the central message.
Then there is the time factor. ‘Read this first: time limits’ cautions the headline on the first page of the text, followed by ‘read this second’ and eventually ‘read this third: mitigation’. In other words, if you have lost your job, get cracking and start assembling your evidence now – it may be months before you get a hearing – and do read this easy-to-read book, with its wealth of resources for those wanting further information on cases, statutes, statutory instruments and so forth. About the Author

Higher Education Academy. In 2003 she led a team to victory in the National Client Interviewing Competition of England and Wales who went on to represent England and Wales in the international final. She is an accomplished author and has published extensively in the areas of stalking, drug-assisted rape and identity fraud. Stefan Fafinski is a law lecturer at the University of Leeds and has held teaching and research positions at the University of East Anglia and Middlesex University. He has published a number of articles in a broad range of academic and practitioner journals on technological and legal issues. He won the 2006 British Association Joseph Lister Award for his work on computer misuse. He also undertakes expert witness work for the legal profession.

Family lawyers in Nigeria : Myth or reality

Having attorneys retained by families as ‘family lawyers’ may be viewed as a means of attaining the divinely ordained equal justice for all. But delays in the justice system, poverty, and low awareness are among the factors that could hamper the use of family lawyers in Nigeria.

Professor C.J. Amasike, chairman of the International Dispute Resolution Institute (IDRI) said disputes are inevitable in human relations, explaining that this raises the need for adjudication, which he said are better handled by persons with skills of Alternative Dispute Resolution (ADR) mechanisms.

“Disputes and conflicts are part of human nature. Even in heaven there was a fight between Lucifer and his supporters and Angels,” he said.

Kehinde Ogunwumiju (SAN) said lawyers are not just meant for families’ cases but also those in big businesses.

“For instance, if it is a family that have a lot of lands, property, business, like those big families in Lagos and Ondo states, you have lawyers that help them deal with them,” he said.

“Having family lawyers is very important,” according to Barr Ezenwa Anumnu, a factional chairman of the Nigerian Bar Association (NBA), Abuja Branch. “You find out that you might always have issues that need a lawyer. In Abuja the law practice is still like trading, but in Lagos you have family lawyers for writing of wills, agreements, estates, conveyancing etc.”

On the form of fees for such lawyers retained by families, Anumnu said there are no hard and fast rules around the payment of legal fees for such lawyers.

“It depends on what you agree with the person. The lawyer may discount some fees and may not charge on commercial rate depending on some other services or provisions provided for them.

“Everybody must have a doctor and a lawyer. You might always have issues to deal with lawyer and doctor. For instance, everybody should make a will, it’s not as if they are going to die,” he added.

For his part, Barr Francis Mgboh said it is ‘very essential’ for every family to retain a lawyer, some of which could be family members or friends, who could always render legal advice to avoid mistakes.

“It is more essential than having a doctor. Ignorance of the law is not an excuse to commit an offense. Your lawyer is a guide to live in a better society,” he said.

However, many believe as necessary as the need could be, the financial implication could prove too much for many families.

Human Rights lawyer Perspective

A human rights lawyer, Hamid Ajibola Jimoh said just as corporate bodies engage law firms as counsel, it is necessary to have family lawyers in order to avoid troubles, citing medical practice where doctors are engaged.

He however identified financial incapacity as major hinderance to the idea of retention of lawyers by families unlike the case in medical practice, where he said “health is regarded as wealth, which is unavoidable.”

The General Secretary of the Nigerian Bar Association (NBA)’s View

In the same vein, the General Secretary of the Nigerian Bar Association (NBA), Isiaka Olagunju said though there is need for every family to have a lawyer in Nigeria, it is not realistic because of the level of poverty in the country.

He agreed that services of lawyers may not be paid for where the professional rules for pro bono services by lawyers are put into consideration.

Olagunju pointed out that there are about 106,000 lawyer on the roll call of practicing lawyers in Nigeria and the Bar is looking at reducing the numbers for better quality service. But for a country with 198 million people, many would view this figure as insufficient to go round.

Jimoh said the tendency is for everybody to avoid legal issues and troubles. The delay in the disposal of cases in Nigeria affects the confidence of the people in the judicial system.

The Supreme Court still presides over cases, which are inherited by different generations in a family.

Despite all its challenges, the justice system is preferable rather than to self-help. The authorities must therefore do all they can to enhance access to justice and speedy adjudication in the society.

Fake Lawyer nabbed in Lagos Court. Detectives in Lagos have exposed a fake lawyer who had been operating at Ojo Magistrate’s Court for three years. Police spokesman, Chike Oti, identified the suspected fake lawyer as Mr. Uche Julian Nwajiakwu.

According to him, the arrest of Nwajiakwu by officers at Ojo Division, on May 25, marks the second time a fake lawyer would be arrested at Ojo Magistrate Court. The first was the arrest of one Chris Elisha. He was arrested on February 6, 2018. It was on record that Nwajiakwu had been practicing illegally since 2015.

Confession

The suspect allegedly told the police that he fell in love with law practice. Especially, when his friend commissioned him to act as a lawyer in order to serve his tenant a quit notice. The handsome reward of that act served as an encouragement for him. Hi arrest on May 25 while he was arguing on a bail application for his client. His exposure was when intelligent lawyers at the court became suspicious. The lawyers submissions are as follows. ”His quackery was too obvious to be ignored.”

Police

Oti told newsmen: “The police investigation into the case, revealed that the suspect did not study law in any of the Nigerian universities. Not even in any institution anywhere else in the world. Therefore, he is already facing the music at Ojo Magistrate Court for the offence of impersonation.

“The Commissioner of Police, reiterated his warning to professional bodies to properly scrutinise people professing to be members of their body. According to the CP, this is one incident too many and must be checked. The CP noted that the Command had in the recent months, arrested fake medical doctors. And, also other spurious health workers, including fake journalists.”

Other Conviction

Miss Inaku Victoria Oko will be serving a jail terms of two years. This is due to involvement in possession of fake medical reports from a Maitama, Abuja district hospital. The conviction and the sentencing was in the court of Justice Olukayode A. Adeniyi of the High Court of the Federal Capital Territory, Abuja. Miss Oko was brought before the court by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) and accused of procuring a fake medical report in the name of one Aniukwu Richard Chinonso, which was intended to enable him to travel to India for medical treatment.

The commission, in a four-count charge, said that the convict also procured a fake chemical pathology laboratory report form. However, this form was in the name of the same Chinonso. His intention was to support a visa application that would enable to him travel abroad. Subsequently, her conviction and sentencing was six months in jail. However, this was without an option of fine on each of the four counts. The sentences will run concurrently.

Laws of the Land

Section 363 of the Penal Code CAP, 532 Laws of the Federal Capital Territory, Abuja 2006 and punishable under section 364 of the same law. Obviously, her offences violate the laws of the land. Also, part of the counts reads:. “That you Oko Victoria Inaku (f), on the 29th of October, 2014 or thereabouts, at the Maitama District Hospital, Abuja, made a false document to wit:. Medical Report in the name of one Aniukwu Richard Chinonso, allegedly signed by a doctor in the hospital, knowing same to be forged. And, intending that the same shall be dishonestly used as genuine to support a visa application to enable Aniukwu Richard Chinonso (now at large) to travel to India for medical treatment and you thereby committed an offence contrary to section 363 and punishable under section 364 of the Penal Code CAP, 532 Laws of the Federal Capital Territory, Abuja 2006.”
