Logically structured, the book is divided into chapters that broadly correspond to the sequence of employment tribunal proceedings. Practical guidance on each stage of proceedings is methodically delivered chapter by chapter, while at the same time, alerting hopeful claimants to the unwritten rules inherent in the decision making process. The book demystifies the procedures as well as the jargon which emerges as an inescapable part of the tribunal process.
This new fourth edition has been updated to include, most importantly, the new employment Tribunal Rules of procedure 2013, plus useful advice on tribunal fees, as well as guidance on the Early Conciliation Process shortly due to come into force. Those fees of course, are at the centre of Cunningham and Reed’s very sound advice as to whether or not a claimant should go ahead with a claim. Think not about what you’ll get, (probably an unrealistic hope), but what it will cost you to get it – is the central message.
Then there is the time factor. ‘Read this first: time limits’ cautions the headline on the first page of the text, followed by ‘read this second’ and eventually ‘read this third: mitigation’. In other words, if you have lost your job, get cracking and start assembling your evidence now – it may be months before you get a hearing – and do read this easy-to-read book, with its wealth of resources for those wanting further information on cases, statutes, statutory instruments and so forth. Opinion: Consumer protection Real or Illusion
In this survey our reporter asked Nigerians about views concerning the rights of consumers and obligations of service providers according to the consumer protection law if it truly is functional or not. Their response about this law is intriguing.
Mrs. Najite Okugbere a financial analyst is of the opinion that consumer rights awareness low in Nigeria so people do not know if the law exists or not. As such they proposed that unawareness may have affected utilization of consumer protection law she  recommends that  the enactment of consumer  rights, the law enforcement agencies of consumer protection should see to it that consumers know their right. In her words “the enforcement agency should educate people to know that it is their right to ask questions about products they are not sure of and it is their rights to demand for quality products and services and get value for their money.”
 
In support of Mrs Okugbere, Mrs Margret Akpan utilization of consumer rights by
the Nigerian consumers remains an issue of concern because consumers are ignorant on where
to turn to in case they encounter an irresponsible producer or service provider. In her words “ When we are maltreated by companies we don’t know where to go to, we don’t know who to turn to especially with most of this foreign companies and they are using it against us because we don’t know the law, we don’t even know our rights.”
 
Ms. Bidemi Adesanya  a hair stylist says she does not know if there is anything as consumer right law because she has never heard of  it, hence she is not aware of the act
 
Mr. Ladipo Akinola says that the consumer protection law is an illusion and that the government is responsible. To him “Overall responsibility for creating safe markets for consumers lies with the authorities. This is because the process involves: setting
clear rules and guidance on how to develop safe products; and providing adequate tools and resources to market surveillance and enforcement agencies to enable them to assess risks and ensure compliance so that the consumer has nothing to worry about on any products and even if they do. They know where to go and what to do when they get there.
 
Mr. George Williams a Lagos state businessman has it that “any law that is made without the citizens being informed is no law but a mere statement” he further said that  there is a serious need for the governments to step up and drive improvement within the law enforcement agencies and the media, then consumer consumers will defend their rights and ensuring that their voice is heard when substandard products and services is given to them in the development of policy, and the media  will educate the masses
 
 
From our survey, it goes to show that the consumer protection law though it exist but limited awareness of consumer rights makes it look like a mirage, thus consumer suffer exploitation in the market place.

It looks at the matters to which the court must have regard in deciding a claim and the court’s powers to make orders (including the powers of the court in respect of dispositions intended to defeat a claim), the assets out of which financial provision under the Act may be made and the position of personal representatives and trustees. The new edition includes coverage of the important case of Ilott v The Blue Cross and others and looks at the effect of the Supreme Court’s first decision under the Act on the meaning of reasonable financial provisions, testamentary freedom, the position of charities as beneficiaries, the factors that are relevant to the exercise of judicial discretion when deciding what if any award should be made for a claimant and issues relating to grounds of appeal. This new edition also deals with changes brought about by the Civil Partnership Act 2004; the Marriage (Same Sex Couples) Act 2013; the Presumption of Deaths Act 2013; the Inheritance and Trustees’ Powers Act 2014 and the consequential amendments made to the Civil Procedure Rules Part 57 and the Human Fertilisation and Embryology Act 2008. Topic: What should be the punishment for maskup failure to comply? On the easing of covid-19 lockdown in Nigeria wearing of a facemask in public places has become compulsory?


Governor Babajide Sanwo-Olu recently proclaimed the wearing of a facemasks compulsory in Lagos state.
His Ogun state counterpart Governor Dapo Abiodun has said it will begin enforcing the wearing of face masks as from May 1, 2020.
While making this brief he stated the punishment for those who will disobey this law that violators risked being arrested or even isolated for 14 days.
In his words “On the issue of violation of face mask order, I think maybe by the time we are going to implement this face mask order, I will be able to reel out what the punishment of the violators would be; But rest assured that we will arrest you if you don’t wear a face mask. In fact when we arrest you, we take you to an isolation center because we will believe that you want to intentionally inflict or afflict someone with COVID-19. That’s why you are not wearing your face mask. So, we will isolate you for 14 days during which we make you do community service”.
When we reached out to the public to air their views we were met with mix reactions;
Mr Abiodun is of the opinion that community service will be more appropriate saying that the government should perhaps provide free facemasks for the citizens since they were unable to provide adequately the necessary palliatives to reduce the hardship caused be the lockdown
Mrs Folashade Oduntan says
Failure to wear a mask is not a criminal offense and as such should not be treated like one. In her words ” Failure to wear a facemask has not be declared as a crime as a result enforcement will be very difficult. You cannot punish people for what has not been declared a crime. So for me I don’t think there should be any punishment. She speaks further that it is best for government to continue to educate the people on the importance of them wearing a facemask each time they go out. In her words it is for their own good and safety.
While Mrs. Oshikanminu feels that there is no need for any actual criminal consequences for those who choose to ignore the facemask order, however she encouraged that businesses to stop customers from transacting any form of business inside their stores without wearing a face mask as she relays her recent experience in computer village Ikeja that before you are allowed entrance into computer village, you must have your facemask on and wash your hands thoroughly in fact the securities are so mean if you fail to comply just forget about it; You will repeat your journey the next day.
Mr. Chinedu Opara suggested that 14 days isolation with community service is the appropriate punishment
Ms. Grace Funmilayo is of the opinion that a fifty thousand naira fine should be the punishment for failure to comply to the maskup order stating that people are definitely going to comply. Hear her ”if there is a fine, you will see Nigerians will obey. Even if they don’t pay up to fifty thousand, pay five thousand naira two times haba! They will go and buy facemask”
With the relaxation on lockdown restrictions at some places across the state and Covid-19 positive cases in the increase. With more shops opening soon under new guidelines, more people will be going out in public about their daily activity. However, majority of the people are still reluctant to wear masks. We trust that the government and all the law enforcement bodies will see to it and do whatever it takes to ensure full compliance to staying safe.
